01 Acceptance of Terms

By accessing this website or booking our services, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use our site or services.

02 Our Services

Shift Focus Media provides photography and videography services including, but not limited to, wedding and event films, brand and commercial content, automotive and motorsport content, travel films, aerial cinematography, real estate media, and video editing. Specific deliverables, timelines, and pricing are defined in the individual agreement or quote provided for each project.

03 Bookings & Payment

• Project details, fees, and payment schedules are confirmed in writing before work begins.
• A deposit may be required to reserve a date or begin a project; deposits are non-refundable unless otherwise agreed in writing.
• Final deliverables are provided upon completion of payment in accordance with the agreed schedule.

04 Intellectual Property

Unless otherwise agreed in writing, Shift Focus Media retains ownership of all copyright in the photographs and video content we create. Clients receive a license to use delivered content for the purposes outlined in their agreement.

We may use delivered work in our portfolio, on our website, and on social media for promotional purposes unless you request otherwise in writing. All website content, branding, and logos remain the property of Shift Focus Media and may not be used without permission.

05 Client Responsibilities

• Provide accurate information and timely communication needed to complete your project.
• Secure any necessary permits, permissions, or location access required for a shoot.
• Ensure a safe working environment for our team and equipment on location.

06 SMS & Messaging Terms

If you opt in to receive text messages from Shift Focus Media, the following terms apply.

07 Cancellations & Rescheduling

Cancellation and rescheduling terms are set out in your project agreement. We ask for as much notice as possible so we can accommodate changes. Deposits applied to reserve dates may be forfeited in the event of cancellation, as specified in your agreement.

08 Limitation of Liability

To the fullest extent permitted by law, Shift Focus Media is not liable for any indirect, incidental, or consequential damages arising from our services or your use of this website. In all cases, our total liability is limited to the amount you paid for the services in question. In the rare event of equipment failure, illness, or other circumstances beyond our reasonable control, our liability is limited to a refund of fees paid for the affected work.

09 Disclaimer of Warranties

Our website and services are provided "as is" and "as available" without warranties of any kind, whether express or implied, except as required by law. While we bring professional craft to every project, creative results are inherently subjective.

10 Indemnification

You agree to indemnify and hold harmless Shift Focus Media and its team from any claims, damages, or expenses arising from your breach of these Terms or your misuse of our services or website.

11 Governing Law

These Terms are governed by the laws of the State of Wisconsin, without regard to its conflict-of-law principles. Any disputes will be handled in the courts located in Wisconsin.

12 Changes to These Terms

We may update these Terms from time to time. Changes take effect when posted on this page, and the "last updated" date above will be revised accordingly. Continued use of our site or services after changes means you accept the updated Terms.
